Recruitable Diver
Supplier-Client Agreement

Effective Date: December 6, 2024

This agreement (“Agreement”) is entered into by and between Recruitable Diver (“Service Provider,” “we,” or “us”) and the undersigned client (“Client” or “you”).
By purchasing our services, you agree to the terms outlined below.

1. Scope of Services

Recruitable Diver will provide a range of services. These services may include, but are not limited to:

Diving skill analysis and coaching
Assistance with the college recruitment process, including highlight reels, outreach to college coaches, and guidance
Flexibility and strength training programs
Support and recommendations for dive meet attendance

2. No Guarantee of Recruitment

While Recruitable Diver provides tools, coaching, and guidance to help you navigate the college recruitment process, we do not guarantee acceptance to any college or university diving program.

Success depends on factors beyond our control, including but not limited to:

The Client’s performance, skill development, and commitment
College-specific recruitment criteria and roster availability

By agreeing to this contract, you acknowledge and accept this limitation.

3. Payment Terms

Payment must be made in full prior to the delivery of services unless otherwise agreed in writing.
Payments are non-refundable, except in the case of service cancellation by Recruitable Diver.

4. Client Responsibilities

To achieve the best results, the Client agrees to:

Provide accurate and timely information, including videos and materials required for highlight reels and outreach
Follow training, flexibility, and strength program recommendations
Communicate promptly regarding scheduling or updates

As part of this Agreement, the Client also agrees to provide the following deliverables to Recruitable Diver upon making a final college commitment:

A. A clear photograph documenting the Client’s commitment to a college program (“Committed Picture”)
B. A short video testimonial describing their experience with Recruitable Diver
C. Disclosure of the amount of athletic aid received (if applicable)
D. Disclosure of the amount of academic/merit aid received (if applicable)
E. Disclosure of the amount of need-based aid received (if applicable)

Client understands and agrees that all payment obligations continue until these deliverables are provided.

If the Client does not commit to a college program, or discontinues services prior to commitment, the Client must still provide item (B) to the best of their ability.

5. Limitation of Liability

Recruitable Diver shall not be held liable for:

Lack of response or interest from college coaches or programs
The Client’s failure to meet deadlines or provide requested materials
Injuries, accidents, or adverse outcomes resulting from diving or training programs

Total liability, if any, shall not exceed the amount paid for services under this Agreement.

6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary information, including training plans, strategies, or personal details shared during the course of this Agreement.

7. Termination

This Agreement may be terminated by either party in writing.
Refunds will not be issued for services already rendered.

8. Governing Law

This Agreement is governed by the laws of the State of North Carolina.
Any disputes shall be resolved through mediation before litigation.

9. Acknowledgment and Agreement

By making payment, the Client acknowledges that they have read, understood, and agree to the terms of this Agreement.
